Common Defects

Known Volkswagen Lemon Law Issues
in New York

Under NY General Business Law § 198-a, if your Volkswagen has been in for the same repair 4+ times — or been out of service 30+ days within the first 2 years or 18,000 miles — the manufacturer must buy it back or replace it. They pay our fees.

⚙️
DSG Dual-Clutch Transmission
The DSG on Jetta, Golf, Tiguan and Atlas shudders and hesitates at low speed. VW's software updates have not resolved the defect for all owners.
💧
Panoramic Roof Water Leaks
Tiguan and Atlas panoramic roofs leak through clogged drains, damaging electronics and causing mold. Repeated sealing repairs rarely hold.
📱
MIB Infotainment System
The MIB infotainment freezes and loses connectivity. A documented pattern of VW failing to permanently resolve infotainment defects.
🔌
BCM / Electrical Module Failures
Body control and powertrain modules fail prematurely on multiple VW models, causing no-starts and cascading warning lights.
TSI Fuel Pump (HPFP) Failure
The HPFP on TSI 2.0T and 1.4T engines fails suddenly — power loss and no-starts. Same defect as Audi across the VAG platform.
🚗
ID.4 EV System Faults
Charging module failures, BMS warnings and range loss on the ID.4 within warranty — qualifying EV defects at this price point.

⚖️ New York’s Lemon Law Is One of the Strongest in the Country

Under NY General Business Law § 198-a, a manufacturer is presumed to have had a reasonable number of repair attempts if either threshold is met within the first 2 years or 18,000 miles:

4 or more repair attempts for the same defect that continues to exist
30 or more cumulative days out of service for repairs

You are entitled to choose a full purchase price refund (including taxes and fees) or a comparable replacement vehicle. The manufacturer is required to pay your attorney fees and costs if you prevail — meaning our representation costs you nothing.
