Common Defects

Known Toyota Lemon Law Issues
in New York

Under NY General Business Law § 198-a, if your Toyota has been in for the same repair 4+ times — or been out of service 30+ days within the first 2 years or 18,000 miles — the manufacturer must buy it back or replace it. They pay our fees.

⚙️
8-Speed Transmission Shudder
The 8-speed automatic on Camry and RAV4 shudders from a stop. Toyota has issued software updates that partially address the issue.
Hybrid Battery / System Faults
Hybrid battery warnings and unexpected shutdowns on Camry Hybrid and RAV4 Hybrid — particularly in cold NY winters. Repeated battery repairs qualify.
🔊
Engine Knock (Timing Chain)
4-cylinder engines in Corolla and RAV4 develop cold-start knock related to variable valve timing. Dealers often cannot reproduce — but the pattern qualifies.
💨
A/C Compressor Failure
Premature A/C compressor failure on Camry, Highlander and RAV4. Refrigerant loss without visible leak, repeated compressor replacements.
📱
Toyota Infotainment (Android Auto/CarPlay)
The multimedia system drops connections and freezes on 2020–2024 models. Multiple Toyota software updates have not fully resolved the issue.
🛢️
Engine Oil Leaks (Valve Cover)
Valve cover and crankshaft seal leaks on 4-cylinder engines in Corolla and RAV4. Recurring leaks after multiple dealer repairs = qualifying defect.

⚖️ New York’s Lemon Law Is One of the Strongest in the Country

Under NY General Business Law § 198-a, a manufacturer is presumed to have had a reasonable number of repair attempts if either threshold is met within the first 2 years or 18,000 miles:

4 or more repair attempts for the same defect that continues to exist
30 or more cumulative days out of service for repairs

You are entitled to choose a full purchase price refund (including taxes and fees) or a comparable replacement vehicle. The manufacturer is required to pay your attorney fees and costs if you prevail — meaning our representation costs you nothing.
