Do I Qualify?

Your vehicle qualifies if it meets either of these thresholds within the first 2 years or 18,000 miles:

Same Defect, Four Repair Attempts
The same defect or condition has been subject to repair four or more times and the defect continues to exist. Applies to any defect that substantially impairs the vehicle's use, value, or safety.

Days Out of Service
The vehicle has been out of service by reason of repair for a cumulative total of 30 or more calendar days during the 2-year/18,000-mile period. Days at the dealer for any covered repair count.

What can I get — a refund or a new car?
Under NY law you can choose either: a full purchase price refund (including taxes and fees paid), or a comparable replacement vehicle. We advise which is more valuable in your specific case.
Does lemon law apply to used cars?
NY Lemon Law applies to new vehicles. However, certified pre-owned vehicles and certain leased vehicles may be covered. Used vehicles may also have claims under the federal Magnuson-Moss Warranty Act. Call us to evaluate your specific situation.
How long does the process take?
